More Woes For Kirby’s Candidacy

Not only is a group of 22 citizens challenging the legality of Annapolis Alderman Kenny Kirby’s residence. We have learned that another grievance was  delivered to the Board of Elections this evening outlining several other reasons why Kenny Kirby’s candidacy should not be certified and the Alderman should be removed from the City’s upcoming elections.

It appears that Alderman Kirby continues to have a certain disregard for the “Fair Election Practices” contained in the Code of Ordinances for the City of Annapolis. The Code is clear in stating in 4.44.100E that the provisions of the code are “mandatory and not directory.”

Thus, I respectfully request that the Board of Supervisors of Elections not certify the candidacy of Alderman Kenneth Aaron Kirby, and prohibit any acceptance of a certificate of candidacy on his behalf. Any lesser action would invalidate the campaign fund reporting requirements and deprive Annapolis voters of their right to a fair and free election,

In the letter, Community Activist, Scott Bowling points out that the Alderman failed to file a timely campaign finance report in 2012. In addition, the report is incomplete, which Bowling asserts is considered the same as a failure to file.

Further, Bowling points out that in 2011 there were several inconsistencies in an audited report that he did file, which were never addressed. According to Bowling’s interpretation of the City Code, failing to address and correct any inconsistencies is also akin to failure to file.

Citing the City Charter and Code, Bowling points out that both of these infractions make Kirby ineligible for office and has asked the Board of Elections to not certify his candidacy and deny the Alderman’s participation in the upcoming City elections.

If Kirby’s candidacy is not certified, the Annapolis Democratic Central Committee will be able to replace Kirby with a candidate of their choosing on the Primary ballot for the September primary.
